1. Who we are and what this is

This website is operated by Lindhöl ("Lindhöl", "we", "us", "our"). Throughout the site, these Terms of Service apply to you, the visitor or customer ("you", "your").

By visiting our site or buying something from us, you agree to be bound by these Terms of Service, together with our Privacy Policy, Shipping Policy and Return Policy, which are incorporated here by reference. If you do not agree with these terms, please do not use this site.

2. Who can buy

You must be at least 18 years old, or the age of majority where you live, to place an order. We currently ship to addresses within the United States only.

3. Health and safety — please read this part

The Lindhöl massager is a personal wellness product. It is not a medical device. It is not intended to diagnose, treat, cure or prevent any disease or medical condition. Nothing on this website is medical advice, and nothing we say should be taken as a substitute for the advice of a qualified healthcare professional.

Do not use the product, and speak to your doctor first, if you are pregnant, have a pacemaker or any other implanted electronic device, have deep vein thrombosis or a blood clotting disorder, have osteoporosis, have a recent injury, fracture, surgery or open wound in the area, have reduced skin sensation, or are being treated for any condition affecting the neck, spine or circulation.

Do not use the product on the front or sides of the throat, over the carotid arteries, on the head, on broken or irritated skin, or while sleeping, driving or bathing. Do not use it on children. Stop immediately and seek medical advice if you feel pain, dizziness, numbness or any unusual sensation.

The heat function warms the skin. Do not use it on an area with reduced sensation, and do not use it for longer than the session length indicated in the manual. Follow the instructions supplied with the product.

You are responsible for using the product as instructed. To the fullest extent permitted by law, we are not liable for injury or loss resulting from use that does not follow the supplied instructions and the warnings above.

4. Products, descriptions and prices

We do our best to display our products, their colours and their features accurately, but we cannot guarantee that your screen shows colours exactly as they are. Product photography is illustrative.

All prices are shown in US dollars and are subject to change without notice. We reserve the right to correct any error in a price or product description, to limit the quantity of any product sold, and to refuse or cancel any order at our discretion, including where we suspect fraud or where a product was listed at an obviously incorrect price. If we cancel an order you have already paid for, we refund you in full.

5. Orders

Placing an order is an offer to buy. The contract is formed when we send you a dispatch confirmation, not when you receive an order confirmation email.

You agree to provide accurate, current and complete purchase and account information, including a correct shipping address. We are not responsible for orders delivered to an address entered incorrectly by you. See our Shipping Policy for what happens in that case.

6. Payment

Payments are processed by Shopify and its payment providers. We do not see or store your full card details. By submitting your payment information you authorise us to charge the total shown at checkout.

7. Delivery, returns and refunds

Delivery times, costs and lost-parcel handling are set out in our Shipping Policy. Returns, the 30-day window and the condition requirements are set out in our Return Policy. Both form part of these terms.

8. Faulty or damaged products

We do not offer an extended manufacturer warranty beyond the window described below, and none is implied by anything on this site.

What we do offer is simple. If the product arrives faulty or damaged, or fails through no fault of your own within 30 days of delivery, we will replace it or refund you in full, and we cover the shipping both ways. Email support@lindhol.com with your order number and photographs or a short video showing the problem. Damage that is visible on arrival should be reported within 48 hours of delivery.

This does not cover damage caused by misuse, dropping, liquid ingress, use outside the supplied instructions, or unauthorised repair or disassembly. Nor does it cover normal wear of the fabric, the strap or the silicone nodes, or the gradual reduction in battery capacity that is normal for any rechargeable battery.

Nothing in these terms is intended to exclude or limit any right you have under applicable consumer law, including any implied warranty that cannot lawfully be excluded in the state where you live.

9. Our content

All content on this site — text, photographs, video, graphics, logos and the name Lindhöl — is owned by us or licensed to us and is protected by intellectual property law. You may not copy, reproduce, republish or use it commercially without our written permission.

10. Reviews, comments and other submissions

If you send us reviews, photographs, comments or suggestions, you grant us a non-exclusive, royalty-free right to use, edit and publish them in any medium, with attribution to the first name and initial you provide. You agree that your submission is your own, is truthful, does not infringe anyone else's rights and contains no unlawful or offensive material. We may edit or remove any submission, but we are under no obligation to monitor them.

11. Things you may not do

You may not use this site or its content for any unlawful purpose, to solicit others to perform unlawful acts, to infringe our or anyone else's intellectual property, to harass or discriminate, to submit false information, to upload malicious code, to scrape or harvest data, to interfere with the security features of the site, or to attempt to gain unauthorised access to it.

12. Third-party links

Our site may link to third-party websites or content. We are not responsible for their content, accuracy or policies, and a link is not an endorsement. Any dealing you have with a third party is between you and them.

13. Disclaimer and limitation of liability

The site and the products are provided "as is" and "as available", except where a warranty is expressly given in section 8 or is implied by law and cannot be excluded. We do not warrant that the site will be uninterrupted, timely, secure or error-free.

To the fullest extent permitted by applicable law, Lindhöl, its directors, employees and suppliers shall not be liable for any indirect, incidental, special or consequential loss, including lost profits or lost data, arising from your use of the site or the product. Where liability cannot be excluded, our total liability is limited to the amount you paid for the product.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

14. Indemnification

You agree to indemnify and hold harmless Lindhöl and its suppliers from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

15. Errors on the site

Occasionally there may be information on the site that contains a typographical error, inaccuracy or omission relating to a product description, price, availability or delivery time. We reserve the right to correct any error and to change or update information at any time without prior notice.

16. Severability and entire agreement

If any part of these terms is found to be unlawful or unenforceable, that part is severed and the rest remains in force. These Terms of Service, together with the policies referenced above, are the entire agreement between you and us regarding your use of the site and supersede any earlier communications.

17. Governing law

These Terms of Service are governed by the laws of Spain, where Lindhöl is established. This does not deprive you of the protection of any mandatory consumer protection law of the state or country where you live, and it does not prevent you from bringing a claim in your local courts where the law gives you that right.

18. Changes to these terms

We may update these Terms of Service at any time by posting the revised version on this page and changing the "Last updated" date. It is your responsibility to check this page periodically. Continuing to use the site after a change means you accept the revised terms.
